1. Acceptance and hierarchy of documents

By placing an order, making or paying for a booking, accepting a quotation, attending an event or otherwise accepting supply, you agree to these Terms. A booking owner who books for others must ensure each attendee receives all relevant warnings, policies and participation requirements.

Specific written terms issued for a private, corporate, wholesale or custom arrangement apply in addition to these Terms. If documents conflict, the more specific term applies to that subject matter to the extent lawful, but no document overrides a mandatory law or the prescribed wording of an applicable statutory form.

2. Eligibility, booking information and bookings for others

You must have legal capacity to contract with us. A booking owner must provide complete and accurate booking information and, where requested, the first name, last name, email and mobile number of every attendee included in the booking.

If you book, pay or register for another person, you confirm you are authorised to provide their information and to make the booking arrangements. Each adult participant must still personally complete any document that must be executed by that participant; no booking owner or organiser may sign an adult participant waiver for another adult.

3. Minors

Participants under 18 may attend only where the relevant experience permits minors and only while accompanied and actively supervised for the entire event by a parent, legal guardian or another adult authorised by the parent or guardian and accepted by Back 2 Basics Traditions.

A completed minor participant form, required health and emergency information, mandatory media authorisation and supervising adult attendance are strict conditions of the minor’s attendance. The form does not exclude or limit rights that a child has under law. Alcohol will not be supplied to a minor.

4. Orders, bookings and contract formation

Website listings, social posts, menus, event pages and quotations are invitations to purchase unless expressly stated otherwise. We accept an order or booking when we issue confirmation after required payment and information have been received, or when we otherwise expressly accept it.

We may decline an order or booking before supply for a genuine pricing or listing error, unavailable stock or ingredients, insufficient event capacity, failure to receive payment or required information, fraud or payment concerns, legal or licensing restrictions, safety concerns, or another legitimate operational reason. If we decline after taking payment and no goods or services are supplied, we will provide the refund required by law and our Refund Policy.

5. Prices, payment methods and surcharges

Prices are in Australian dollars and include GST where applicable unless clearly stated otherwise. We may accept payment through any method or provider we approve from time to time, including without limitation WooCommerce checkout, Square, Stripe, PayPal, Apple Pay, credit or debit card, digital wallet, payment link, invoice, direct bank transfer, EFT or direct deposit. We may add, replace or discontinue payment methods.

A booking is not confirmed until the required amount has been received in cleared funds and required booking information has been supplied. For direct transfer, use only bank details supplied or verified by Back 2 Basics Traditions. If you receive changed payment instructions, verify them using a known contact channel before paying.

Any payment surcharge or unavoidable fee will be disclosed in accordance with applicable pricing law. A card surcharge will only be imposed where lawful and permitted by the applicable payment-network or provider rules and will not exceed the maximum amount permitted by law. If no surcharge-free payment option is available, displayed pricing will include the minimum unavoidable surcharge where required.

6. Products and artisanal variation

Many products are handmade, small-batch or seasonal. Reasonable variations in appearance, colour, flavour, texture, packaging, produce, garnish or batch profile are inherent in artisanal production and do not of themselves constitute a defect. Product and event images are illustrative. Consumer guarantees continue to apply where the Australian Consumer Law applies.

7. Cooking experiences – risks, instructions and conduct

Hands-on cooking experiences involve active participation and may include knives and sharp utensils, hot liquids and oils, steam, ovens, stovetops, appliances, cookware, glassware, food handling, standing, carrying items, movement between workstations, slips, trips, burns, cuts, allergic reaction, foodborne illness, interaction with other participants and, for adults, alcohol service or tasting.

Every attendee must comply immediately with lawful and reasonable safety, food-hygiene, equipment, movement, venue and responsible-service-of-alcohol directions. An attendee must not use equipment contrary to instructions and must report hazards, injuries, illness or unsafe conditions.

Back 2 Basics Traditions may refuse, suspend or stop participation where reasonably necessary for health or safety, food hygiene, supervision, legal or licensing compliance, responsible service of alcohol, venue rules, protection of property or the wellbeing of staff, contractors or other attendees.

8. Allergies, dietary requirements, health and accessibility

You must not book on the assumption that an undisclosed requirement can be accommodated later. Information must be complete, accurate and current, and any change must be notified before participation. We may seek additional information reasonably necessary to assess safety or a requested adjustment.

We will consider reasonable adjustments required by applicable discrimination law. We may refuse or modify participation where, after considering applicable legal obligations and reasonably practicable controls, the requirement cannot be safely or lawfully accommodated or would impose an unjustifiable hardship. Nothing in these Terms authorises unlawful discrimination.

Reasonable allergen and food-safety controls cannot guarantee an allergen-free environment or eliminate all risk of unintended cross-contact. Participants must bring any personal or emergency medication or device they may require and provide relevant emergency-response information before participation.

9. Mandatory adult waiver – no signature, no services

If an adult does not execute the required waiver as issued, Back 2 Basics Traditions will refuse participation and will not provide the cooking-experience services. The consequences for any booking payment are governed by the Refund Policy and any non-excludable rights under law.

10. Food-handler health and hygiene

A participant who knows or suspects they have a foodborne illness or symptoms that may indicate one, including vomiting, diarrhoea, fever or a sore throat with fever, must tell us before handling food and immediately if symptoms arise during the experience. A participant must not handle food or food-contact surfaces where contamination may result and must comply with all handwashing, hygiene and contamination-control directions.

11. Alcohol

Where alcohol is supplied, sold or served, it will be handled in accordance with applicable South Australian liquor law, licence conditions and responsible-service requirements. We may require acceptable proof of age or identity and may refuse or stop alcohol service where required by law or where service is unsafe or inappropriate, including suspected intoxication.

Alcohol will not be supplied to a participant under 18. No adult may pass liquor supplied by us to a minor or another person contrary to law. Participants are responsible for their consumption decisions and for arranging safe transport. A person must not drive unless legally and safely fit to do so.

12. Mandatory photography, video and audio

Photography, video and audio recording are mandatory conditions of attendance at our cooking experiences, tastings and related events unless we expressly state otherwise in writing for a specific event. This applies to participants and other attendees or visitors. If the applicable media authorisation is not given, the person must not attend and Back 2 Basics Traditions will refuse participation or attendance.

Subject to applicable law and the relevant participant or attendance authorisation, Back 2 Basics Traditions may capture and use image, likeness, appearance, voice and participation without further payment or approval, without limitation as to time, territory, medium or frequency, for any lawful business, commercial, advertising, promotional, editorial, educational, archival, publicity or communications purpose that Back 2 Basics Traditions determines. 13. Refusal, removal and participant default

We may refuse admission or stop participation where an attendee fails to meet a mandatory attendance condition or creates a genuine health, safety, legal, hygiene or operational issue. This includes an unsigned required form; absent minor supervision; refusal of mandatory media authorisation; intoxication; aggressive, threatening or discriminatory behaviour; unsafe conduct; serious non-compliance with directions; undisclosed information creating a material safety issue; foodborne-illness symptoms that create contamination risk; or inability to verify age where required for alcohol service.

Where refusal or removal results from the attendee’s breach, conduct or failure to meet a disclosed mandatory condition, the booking will be treated under the customer-default provisions of our Refund Policy, subject to any non-excludable legal right.

14. Refunds, transfers, cancellations and non-attendance

Our Refunds, Returns, Transfers & Cancellations Policy forms part of these Terms. Experience bookings are non-refundable for customer change of mind or personal circumstances except where law requires otherwise. A place may be transferred to a replacement attendee in accordance with that policy, provided the replacement meets all event requirements and executes all required documents.

15. Changes or cancellation by Back 2 Basics Traditions

We may reasonably change an event’s menu, ingredient, supplier, host, timing, format or other operational detail where necessary because of seasonal availability, illness, staffing, safety, legal requirements or another legitimate operational reason, provided the overall contracted service is not materially diminished without an appropriate remedy.

If we cancel, postpone or materially change the date, time, location or core nature of an event, the remedies in our Refund Policy apply. Nothing in these Terms excludes compensation or another remedy required by the Australian Consumer Law, including for reasonably foreseeable loss where the law provides that right.

16. Delivery, collection, title and risk in goods

Delivery timeframes are estimates unless expressly guaranteed. Risk in goods passes on delivery or collection, subject to applicable consumer rights. Title remains with us until cleared payment in full is received. If goods fail to comply with a consumer guarantee, risk and return-cost responsibilities are governed by the Australian Consumer Law and our Refund Policy rather than this clause.

17. Gift cards and vouchers

If we issue a gift card or gift voucher, its specific terms will be disclosed with it. Where Australian gift-card laws apply, the card or voucher will have at least the minimum statutory expiry period, required conditions will be displayed, and prohibited post-purchase fees will not be charged. Statutory exceptions may apply to certain promotional or discounted vouchers or specified-period experiences.

18. Website and intellectual property

You must not misuse our website, interfere with security or functionality, introduce malicious code, scrape content unlawfully, impersonate another person or use our systems fraudulently or unlawfully.

Unless otherwise stated, Back 2 Basics Traditions owns or controls intellectual property in its branding, website, photographs, graphics, written content, participant materials, original collateral and other business materials. No commercial reproduction or exploitation is permitted without our written permission or another legal right.

19. Reviews, testimonials and user content

If you voluntarily submit or publish a review, testimonial, tag, comment, photograph or other content directed to or featuring Back 2 Basics Traditions, you grant us a non-exclusive, royalty-free licence to reproduce, repost and display that content for lawful business and promotional purposes, subject to applicable law and any platform rights. We will not knowingly attribute words to you that you did not make or use content in a misleading way.

20. Privacy

Personal information is handled in accordance with our Privacy Policy, applicable collection notices and applicable law. Health and allergy information is handled as sensitive information where the law requires that treatment.

21. Consumer guarantees and limitation of liability

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, statutory right, remedy, duty or liability that cannot lawfully be excluded, restricted or modified. Where the Australian Consumer Law applies, goods and services come with the guarantees and remedies provided by that law.

To the maximum extent permitted by law, we exclude liability for loss that is not caused by our breach and for external or incidental costs that the law permits us to exclude. We do not exclude liability for reasonably foreseeable loss or damage where the Australian Consumer Law or another law gives the customer a non-excludable right to recover it.

For an adult hands-on cooking experience treated as recreational services in South Australia, any exclusion, restriction or modification of liability for personal injury operates only to the extent validly agreed under the applicable Adult Participant Waiver and the Fair Trading Act 1987 (SA).

22. Participant indemnity – maximum lawful extent

To the maximum extent permitted by law, an adult customer or attendee indemnifies Back 2 Basics Traditions and its employees, contractors and agents against claims, liabilities, losses, property damage, costs and expenses, including reasonable legal costs, to the extent caused or contributed to by that person’s unlawful or negligent act or omission, breach of these Terms or a participant document, failure to follow a lawful or reasonable direction, inaccurate or withheld information required for safe participation, damage to property, unlawful supply of alcohol to another person, or injury or loss that person causes to another person.

This indemnity is not intended to indemnify Back 2 Basics Traditions for liability that cannot lawfully be excluded, restricted, modified or indemnified, and does not transfer or contract out of any work health and safety duty or other statutory obligation imposed on Back 2 Basics Traditions.

23. Events beyond reasonable control

If circumstances beyond our reasonable control prevent or materially delay supply, we may take reasonable steps to reschedule, substitute or cancel the affected supply. Examples may include extreme weather, emergency orders, venue unavailability not caused by us, serious illness, utility failure, transport disruption or other events we could not reasonably prevent. Any refund, credit, transfer or other remedy will be provided in accordance with our Refund Policy and any non-excludable legal rights.

24. Complaints, changes and governing law

Please contact us promptly if you have a complaint so we can investigate. We may update these Terms for future transactions. The version presented or made available for the relevant order or booking will generally apply to that transaction unless a change is required by law or agreed with you.

These Terms are governed by the laws of South Australia and applicable Commonwealth law. The parties submit to the non-exclusive jurisdiction of courts and tribunals competent to determine disputes arising in South Australia, without limiting any statutory jurisdiction or consumer right.
